German Workwear Regulations: What Employers Need to Know
Germany has some of the most comprehensive workplace safety legislation in Europe, and PPE management is a key component. The Arbeitsschutzgesetz (ArbSchG) establishes the general duty for employers to ensure workplace safety, while the PSA-Benutzungsverordnung (PSA-BV) specifically governs the provision and use of personal protective equipment. Employers who fail to comply face penalties from the Gewerbeaufsichtsamt (trade supervisory office) and liability exposure under civil law.
The Gefaehrdungsbeurteilung (risk assessment) is the starting point for all PPE decisions in Germany. Before selecting any PPE, employers must conduct and document a thorough risk assessment for each workplace and activity. This assessment determines which PPE categories are required, what protection levels are needed, and how often items must be inspected. The risk assessment must be reviewed whenever work conditions change and updated at least annually.
German regulations require that PPE meets EU standards and carries the CE marking. All PPE must comply with Regulation (EU) 2016/425 and the relevant harmonized EN standards. For example, safety boots must meet EN ISO 20345, high-visibility clothing must meet EN ISO 20471, and respiratory protection must meet EN 149. Track the CE certification and applicable EN standard for every PPE item in your system.
Employers must provide PPE free of charge and maintain it at their own expense. Under paragraph 3 of PSA-BV, the employer bears all costs for procurement, cleaning, maintenance, repair, and replacement of PPE. Deducting PPE costs from employee wages is not permitted. Additionally, the employer must ensure PPE is in a hygienic and functional condition — which means regular cleaning, inspection, and timely replacement.
Documentation and training requirements are extensive. Employers must maintain Betriebsanweisungen (operating instructions) for each PPE category, train employees on correct use before first deployment, and document both the instruction content and attendance. Annual refresher training is required. Digital records that timestamp training completion and link it to PPE assignments provide the evidence needed during audits by the Berufsgenossenschaft (trade association) or Gewerbeaufsicht.
